Terms of Service.

Agreement
These Terms of Service (“Terms”) govern your access to and use of HazyMails (the “Service”). By signing in, you agree to these Terms. If you don’t agree, don’t use the Service.
Eligibility and accounts
- You must be at least 16 years old to use the Service.
- The Service is invite-only. You are responsible for keeping your profile name and password secure, and for everything that happens under your account.
- You must own, or have the right to send from, each mailbox you connect to the Service.
Acceptable use
You agree that you will not use the Service to:
- Send unsolicited bulk email in violation of any anti-spam law, including CAN-SPAM (US), CASL (Canada), GDPR (EU), PECR (UK), or the Spam Act 2003 (Australia).
- Send to recipients who have not opted in or who do not have a clear pre-existing business relationship with you, where the law of the recipient’s jurisdiction requires such consent.
- Misrepresent the sender (forged From / Reply-To headers, deceptive subject lines, impersonation of another person or entity).
- Send malware, phishing content, illegal content, hate speech, harassment, or sexually explicit material to minors.
- Send adult / dating / gambling / cryptocurrency “pump” / get-rich-quick schemes through the Service.
- Circumvent the per-mailbox daily caps or other deliverability protections, or interfere with the Service’s operation.
- Resell or sublicense access to the Service, or use it to provide a competing service to a third party.
- Violate the terms of any connected mail provider (Google, Microsoft, etc.).
Every campaign must include a working unsubscribe / opt-out mechanism where the law requires one, and must honor opt-out requests within the timeframe required by that law. You are solely responsible for compliance.
Your data and content
You retain ownership of recipient lists, copy, and attachments you upload (your “Content”). You grant us a limited, non-exclusive license to host, process, and transmit your Content solely to provide the Service. We don’t claim any rights to it beyond that. See the Privacy Policy for what we do with it and how long we keep it.
Provider compliance
When you connect a Google or Microsoft mailbox, you remain subject to that provider’s terms (e.g. Google Workspace / Gmail terms, Microsoft Services Agreement). The provider can suspend, rate-limit, or terminate your access independently of us; we have no control over that. If a provider revokes our app or your OAuth grant, the Service will stop sending from that mailbox.
Deliverability
We enforce per-mailbox daily caps and per-send jitter to protect your sender reputation, but we make no guarantee that any specific message will reach the inbox, land out of spam, or be delivered at all. Domain authentication (SPF, DKIM, DMARC) is your responsibility.
Suspension and termination
We may suspend or terminate your access without notice if we reasonably believe you are violating these Terms, putting the Service or other users at risk, or causing material harm to recipients or providers. You can stop using the Service at any time by disconnecting your mailboxes and asking us to delete your account.
No warranties
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that emails will be delivered.
Limitation of liability
To the maximum extent permitted by law, in no event shall the operator of HazyMails be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or sender reputation, arising out of or related to your use of the Service. Our total cumulative liability for any claim arising out of or relating to the Service is limited to the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) USD 50.
Indemnity
You agree to indemnify and hold harmless the operator of HazyMails from any claim, demand, loss, or damages (including reasonable legal fees) made by any third party arising out of (a) your Content, (b) your use of the Service, or (c) your violation of these Terms or any applicable law.
Changes
We may update these Terms from time to time. We’ll change the “Last updated” date and, for material changes, give reasonable notice in-app or by email. Continued use of the Service after the changes take effect means you accept the revised Terms.
Governing law
These Terms are governed by the laws of the jurisdiction in which the operator resides, without regard to conflict-of-laws principles. Any dispute that cannot be resolved informally will be brought exclusively in the courts of that jurisdiction.
